Milwaukee man bound over for trial

A Milwaukee man has been charged in connection with the Wawatosa hotel shooting that injured three police officers on trial.

Kenneth Burnie, 33, appears in court for a preliminary hearing on Friday, November 19. He was charged with 10 full counts.

According to a criminal complaint, Wauwatosa police were dispatched to the Radisson Hotel on Mayfair Road and North Avenue early Saturday, November 6 to investigate the “active shots” complaint. These officers were directed to the second floor of the hotel where they found “several firearms casings as well as unspent cartridges on the lobby floor”. The complaint stated that the officers “noted multiple bullet holes in the walls and ceiling and began searching room to room to search for potential victims.”

The officers were provided with the master key to unlock the rooms. The complaint stated that the officers “knocked and identified themselves in every room. In every inhabited room, the occupants opened the door and allowed the officers to briefly search the room.”

When the officers approached one of the rooms, they could hear a TV but could not get the person into the room to open the door. About eight minutes after trying to enter the room, three officers “attempted to break through the door with a ram. After five blows were thrown, the ram made a circular hole in the door. The fifth blow hit the door, and several gunshots were heard” at the officers.

Three officers were injured in the incident, and the complaint stated that “at least two other officers were converging at the door at the time of the shooting and were moments away from standing in the line of fire.”

The complaint says that the officers returned fire but did not hit the suspect. Shortly thereafter, Bernie was arrested.

Inside the hotel room, officers recovered two firearms, pistol casings and 16 grains that tested positive for MDMA.

Bernie’s next appearance in court is scheduled for December 13.
